PREAMBLE

Whereas, ShortyLinks.io is a website owned, operated and governed by ShortyLinks LLC a limited liability company by a sole proprietor; and
Whereas, these Terms and Conditions have been drafted to provide information regarding rules, regulations and conditions set by ShortLinks.io; and
Whereas, throughout the Terms and Conditions, Privacy Policy, and our website the terms such as “we”, “our”, “us” and ShortyLink.io have been used to describe ShortyLinks.io’s website and services therein.
Therefore, after availing, subscribing or visiting to the website of ShortyLinks.io the users, subscribers and visitors will be assumed to be in consent with these Terms and Conditions as well as our Privacy Policy.

4. RIGHT OF REJECTION

We have the right to reject URLs if we find that they are submitted or later remove, disable or redirect shortened URLs for any reason. The intention of ShortyLinks.io is only to do this where they violate the Terms & Conditions or the spirit of fair usage, or it has a reason to suspect they do (e.g., if they appear on a blacklist consulted by ShortyLinks.io).

Please note that any rejected URLs by ShortyLinks.io can be reinstated if it is deemed appropriate due to our mistake.

5. SERVICES SUBSCRIPTION

The users will be able to pay for a specific term of the subscription (either monthly or yearly) through the Stripe payment platform. The user’s account will be auto-renewed after each term until either the user chooses to turn off the auto-renewal feature or the user cancels the subscription. All of the payment-related data such as credit card, and debit card information will be processed through Stripe and it will treat and safeguard your data with total security and with the exclusive purpose of processing the services of ShortyLinks.io. We have the right to change, add or remove any payment platforms or gateways for the purpose of providing our services.
You can cancel your subscription at any time and you will continue to have access to the services through the end of your monthly or yearly billing terms. However, after canceling your subscription before the renewal date you will not be charged for the next subscription.

5.1. Auto Payment Deduction Authorization

By using our services and subscribing to our services you (on your behalf) hereby authorize us to periodically deduct payment according to the subscription plan that you have chosen. The deduction of payment is automatic through the payment gateway (currently Stripe) and the payment data is stored and handled by Stripe.

5.2. Disclaimer of Liability

While availing any of the payment methods offered by us, we are not responsible or take no liability of whatsoever nature in respect of any loss or damage arising directly or indirectly to you including but not limited to the following:

Lack of authorization for any transactions since all payments will be processed through automatic and digital means.
Exceeding the preset limit mutually agreed upon by you and between your banks.
Any payment issues arising out of the transaction.
The decline of transactions for any other reasons.

6. PERSONAL RESPONSIBILITIES OF USERS

If you are a registered user of our services and you are using our services through the website, you are entirely responsible for the shortened URLs and any harm resulting from, that content.

6.1. Restrictions

The shortening and linking of copyrighted content and any other content which is considered the property of someone else is strictly prohibited.
Users are not allowed to create shortened URLs that are used in commercial e-mail.
When shortening any URLs make sure that the link does not lead to (or contain) any viruses, worms, malware, Trojan horses, or other harmful or destructive content.
Make sure that the URL being shortened is not spam, is not machine- or randomly generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third-party sites or boost the search engine rankings of third-party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing).
It is not allowed to shorten URLs for getting advertised via unwanted electronic messages such as spam links on newsgroups, email lists, other apps and websites, and similar unsolicited promotional methods and it is not allowed to create shortened URLs that are used for unsolicited advertising (spam) including email, forum posts, SMS messages and spam posts/messaging on social networks such as Facebook or Twitter.
By using our services, you acknowledge that you will not conduct any unsolicited or unauthorized advertising, direct or indirect marketing, participate in any ‘get-rich’, ‘pyramid schemes or dubious competitions, or link any websites that require users to fill out paid surveys or promote spamming by any means.

6.2. Prohibited Content

The shortening of the following type of content is strictly prohibited through our website and linking of such content will not be tolerated in any way.

Children’s Pornography is strictly prohibited including images, videos, and sketches which deem to provide an idea about kids having an explicit or sexual position or act. Not only such content will be removed as soon as possible but we will report such behavior along with the user/member information to concerned authorities and law enforcement agencies.
Content with fake names, fake profile pictures, and catfishing is strictly prohibited, and doing so will result in an immediate ban.
Linking of content containing racism, bullying, sectarianism, threats, or using language with violence is not allowed.
Shortening of links, websites or postings that lead to money laundering or terrorism or other violent forms of similar nature is prohibited.

7. MODIFICATIONS OF SHORTENED URLs

Users who create ShortyLinks.io shortened URLs cannot modify their destinations. This has been done to prevent the abuse of our services.

We do not share any information with third parties unless explicitly stated in the Privacy Policy. We also do not collect or store any information other than that required to provide you with the services and to provide us with general website usage statistics.

9. COPYRIGHT POLICY AND INTELLECTUAL PROPERTY RIGHTS

We are just providing service as service providers and any links provided through our website services will be the responsibility of the subscribers who are going to shorten the links in the first place. There is a possibility that a visitor or user of these links may end up on another product or another website. ShortyLinks.io and ShortyLinks LLC are not responsible for the results of any actions taken based on information provided on and through the links a person may choose to click and afterward visit.

11. LIABILITY DISCLAIMER

Liability of any kind by ShortyLinks.io and ShortyLinks LLC for direct, indirect, special, incidental, or consequential damages (including damages related to devices, investments, products, or lost profits or for any claim or demand by any third party, even if we had reason to know of the possibility of such damages claim or demand arising under any theory of law in tort, contract, strict liability) from, or in connection with, the access (or the inability of access) to or use of the ShortyLinks.io’s website is excluded and is hereby expressly disclaimed by our company to the fullest extent permitted under applicable law and regulations.
